Constitutional Amendments...might we at sportsline do better?  I'll present the Amendments in no particular order, or...more to the point...in whatever order arbitrarily suits me.  Thusly:

Amendment 3 - Cruel and Unusual Punishment:

Excessive bail shall not be required, not excessive fines imposed, nor cruel and unusual punishments inflicted.

 


 

I will start by saying that I understand...and agree with...prohibitions against cruel punishments.  If we have not yet managed to move firmly to whatever moral high ground prohibits "burning at the stake" or "flaying alive" then we clearly lack the wherewithal to make the fine distinctions required for full appreciation of this amendment.

But what about "unusual" punishment?  Should we be confined in those ways?  Why prohibit punitive measures distinguished only by their ingenuity?  Do any of you have uncommon suggestions which would avoid the "cruelty" concerns...while still allowing some degree of creativity?

Please...try to take this seriously.  If you can't manage that...do try to be entertaining.

Cruel and Unusual punishment is not putting someone to death, it is a form of long term torture that was prohibited.  Hanging wasn't cruel, but now there are those who say it is.  A firing Squad wasn't cruel, but there are those who say they are.  Any means in which death is reasonably considered swift would not be considered cruel.  The fact the convict feels pain should have no bearing on whether something is cruel or unusal or not.  Will death be considered swift.  That should be the decdiding factor.


Mikey...feeling pain would be precisely the deciding factor in determining whether or not a punishment is cruel.

JD...I don't know why I'm getting such a kick out of that...but I am.  I fully expected you to return with a mountain of data.  Good thing you didn't...I'm really sleepy.

Of course women can behave badly.  (Someone will likely build a show around that concept someday.)  I never said...or thought...that men were the only possible transgressors.

I have been very pleasantly surprised by the responses to this blog.  Just curious...any thoughts about whether women would be more...or less...amenable than men to creative approaches with punishment?  No difference?
