Amendments

Constitutional Amendments...might we at sportsline do better?  I'll present the Amendments in no particular order, or...more to the point...in whatever order arbitrarily suits me.  Thusly:

Amendment 3 - Cruel and Unusual Punishment:

Excessive bail shall not be required, not excessive fines imposed, nor cruel and unusual punishments inflicted.

 


 

I will start by saying that I understand...and agree with...prohibitions against cruel punishments.  If we have not yet managed to move firmly to whatever moral high ground prohibits "burning at the stake" or "flaying alive" then we clearly lack the wherewithal to make the fine distinctions required for full appreciation of this amendment.

But what about "unusual" punishment?  Should we be confined in those ways?  Why prohibit punitive measures distinguished only by their ingenuity?  Do any of you have uncommon suggestions which would avoid the "cruelty" concerns...while still allowing some degree of creativity?

Please...try to take this seriously.  If you can't manage that...do try to be entertaining.

I know of some work along similar lines done by some religious groups, as well as the Truth and Reconciliation Commission in South Africa.

There are similar programs here in the States.  We must find alternatives to incarceration...we have an insane proportion of our population imprisoned.

Amendments

I think the convicted Enron executive scum and their accountant shills should be made to perpetually scrub toilets for all the former employees who lost pensions and health benefits.  I think all Exxon executives and the drunken sea captains the hire should be tarred and feathered. I think Barry Bonds should be starved until he is skeletal.  I think OJ Simpson should be passed through a pasta cutter. Think I believe in Hammurabi's code?

Please...try to take this seriously.

Do men have anything remotely comparable in their lives?
Men, probably not.  Obviously, though, male children are subject to sexual crimes.  But, in terms of being put in a bad place,  I doubt that most men experience anything remotely like that.

I cannot think of a single situation that could make me feel the way you did after being intently watched by a rapist.  The closest thing I could imagine would be identity theft, but personally that's not something that would mentally affect me other than to make me really mad.  I suppose a situation could happen where I'm raped by a bunch of burly dudes but it's not a thought that has ever crossed my mind.  Certainly I've never felt the creepy factor of having a rapist staring me down.  If such a situation happened, I'd feel more like smashing him next time rather than feeling creeped out.

I think that certain cases of rape should carry a life sentence.  Certainly any form of violence involved in the act should require a life sentence.  The burden of proof for such a sentence would obviously have to be high to prevent false accusations from leading to someone spending their life in prison, but in cases where there's DNA evidence and clear signs of violence involved, lock 'em up forever.  Same goes for any sexual crimes on children.  You've changed their life forever, therefore you should lose your freedom and never be allowed the chance to do it again.

Creative crimes that aren't cruel and unusual?  Certainly forcing them to deal with the wreckage of their actions is one thing.  I'm not sure I'd want my kid being attended to by a sexual predator, however.  Perhaps forcing them to view children being treated by counselors (with the kid's identity concealed) and the kinds of horrors they have to deal with mentally might help.  But the problem is that those dudes often feel guilty.  They go on hurting kids anyway.  So, you might make them feel guilty by forcing them to confront the results of their actions, but in many cases you wouldn't and when you did, it wouldn't stop them from doing anything in the future.

Life.  That's how you stop them.  Harsh punishment for the freaks that show up at internet stings, too.  Like, 20 years in prison harsh.  I'm just not creative enough to think of a punishment that would change them.  Oh, and I'm not  at all opposed to a lobotomy to curb their desires.

GRR!!  Just typing about it makes my blood boil.

I have probably seen or read the same studies about sexual predators as you have Corv and unfortunately most offenders are doomed to repeat their offenses or worse escalate them.

In the most brutal examples (Jeffrey Dalmer) the warning signs were apparent by the time they enter early puberty.

Is there a solution? Chemical castration? Lpoding them all up on a ship and marooning them on a remote island together out in the middle of the pacific. Putting them in the prison general population and allowing "prison justice" to play its will.

Most cant find ant real employment after incarceration and if they do they could lose their jobs at a moment notice if the employer were to find out. I would not hire a sex offender, no way.
